Waiver of Liability Agreement

This Waiver of Liability Agreement ("Waiver") is made effective as of the date signed below by and between [Platform Name] Home Care ("Company") and the undersigned Tasker ("Tasker").

1. Assumption of Risk

By signing this Waiver, Tasker acknowledges that performing home care services, including but not limited to cleaning, organizing, laundry, pet care, yard maintenance, and small repairs, may involve certain risks. Tasker voluntarily assumes all risks associated with performing these services, including risks of injury, property damage, and exposure to hazardous conditions, such as chemicals, sharp objects, or pet-related incidents.

2. Release of Liability

To the fullest extent permitted by law, Tasker hereby releases, waives, discharges, and holds harmless [Platform Name] Home Care, its employees, contractors, officers, directors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, illness, death, or property damage that may be sustained by Tasker while performing services for the Company, except in cases of gross negligence or intentional misconduct by the Company.

3. No Employee Benefits

Tasker understands and agrees that their engagement with [Platform Name] Home Care is as an independent contractor and not as an employee. Therefore, Tasker is not entitled to any Company-provided employee benefits, including but not limited to health insurance, workers' compensation, or any other benefits or protections typically afforded to employees.

4. Reporting of Unsafe Conditions

Tasker agrees to immediately report any unsafe or hazardous conditions encountered while performing services to the Company. Tasker further agrees to refrain from attempting any repairs or tasks that may pose an unreasonable risk to their safety without prior approval from management.

5. Indemnification

Tasker agrees to indemnify and hold harmless [Platform Name] Home Care from any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney fees) that may arise from Tasker’s performance of services or failure to comply with safety guidelines, except where caused by the Company’s gross negligence.

6. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of [Your State]. Any legal actions arising from this Waiver shall be brought in the courts located in [Your State].

 

Acknowledgment and Acceptance

By signing below, Tasker acknowledges that they have carefully read, understood, and voluntarily agreed to this Waiver of Liability Agreement, including the assumption of risks, release of liability, and indemnification provisions. Tasker further agrees that this Waiver is binding upon their heirs, assigns, personal representatives, and next of kin.
